ACC 2011 CONVICTIONS
Since the inception of the Commission in 2000, the Commission has gained over sixty convictions of Ministers, Senior Public Servants, Lawyers, a Magistrate, and business people to name a few. 2011 has been a success story for the Commission.
ACC Convictions - Story 1
In the early part of 2011, the State indicted the Former Director of the Sierra Leone Road Transport Authority (SLRTA) Sarah Bendu and the Managing Director of Mabella Industries, Hamza Sesay. They were both charged on a ten count indictment. Mrs. Bendu was found guilty on one count charge and fined Le 30,000,000 whilst Hamza Sesay was found guilty on two counts for Misappropriation of public funds. Mr. Sesay was fined Le 30,000,000 on each of the two counts and was asked to refund Le 1,025,600,000 to the SLRTA within the period of eight weeks.
ACC Convictions - Story 2
In the case between the State versus former employee of the Sierra Leone Commercial Bank, John Mans and Finance Officer, Francis Komeh, both accused were charged for the Misappropriation of Public Funds. Mr. Mans was found guilty on two counts, he was asked to pay Le30,000,000 or face imprisonment for three years
ACC Convictions - Story 3
Mohamed Sesay of No. 83 Bass Street, Brookfields, on the other hand, impersonated ACC Investigators and was fined Le 3,000,000 or imprisonment for six months.
ACC Convictions - Story 4
The Former Executive Director, National Coordinator and Regional Coordinator of the Attitudinal and Behavioral Change Secretariat, Philip Conteh, Alieu Badara Kamara and Lansana Zanto Kamara were convicted for corruption related offences. Mr. Conteh and Alieu Kamara were found guilty on ten counts, inclusive of failure to comply with applicable procedures and guidelines with regards management of donor funds. The first two Accused were asked to pay Le 60,000,000 each. The third Accused was fined Le 30,000,000.
ACC Convictions - Story 5
The Executive Director of the Sierra Leone Maritime Administration (SLMA), Phillip Lukulay was convicted on twelve counts of misappropriation of public funds and one count of failing to comply with a requirement, Mr. Lukulay was asked to pay Le 125,000,000 and to refund Le 139,478,000.
ACC Convictions - Story 6
The Procurement Clerk of the Bo Kenema Power Supply BKPS, Bo, Southern Sierra Leone, Mohammed S. Jalloh was fined Le 7,000,000 for the Abuse of his position and Abuse of Office.
ACC Convictions - Story 7
In the case between the State versus Alpha Turay in Makeni, Northern Sierra Leone, the Accused was discharged on all counts. In this case, the trial judge held that the State failed to include a reference to subsection (1) in all the sixty five (65) counts charging misappropriation under section 36 of the Anti- Corruption Act 2008. The Commission has filed an appeal.
ACC Convictions - Story 7
The suspended Boss of the National Revenue Authority, Alieu Sesay, Samuel Cole, Franklyn Pratt, Gloria Gabisi and Fatmata Ojubarra Sesay were acquitted and discharged on all fifty seven counts of corruption offences. The Trial Judge held that the Prosecution had failed to establish that the 1st Accused, Alieu Sesay conspired with his Co- Accused. The Judge also believed that the Prosecution had failed to prove that the 1st, 2nd, 3rd and 4th Accused acted in collusion with regards to the award of the various contracts.
